Personal data

The Gaisbauer Möbelwerkstätten GmbH, FN265892v, Ritzbergerstraße 32 4082 Aschach an der Donau, Austria, collects, processes and uses personal data of its customers in principle only, as far as this is necessary for the supply of our services and achievements. The collection and use of our customers’ personal data regularly only takes place with the customer’s consent. An exception applies in those cases in which obtaining prior consent is not possible for actual reasons and the processing of the data is permitted by legal regulations.

Only such personal data is collected that is required for the implementation and processing of the agreed services or that you have voluntarily provided to us.

Personal data are all data that contain individual details about personal or factual circumstances, for example name, address, e-mail address, telephone number, date of birth, age and gender.

Legal basis for the processing of personal data

Insofar as we obtain the consent of the data subject for processing operations involving personal data, Article 6(1)(a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis for the processing of personal data.

When processing personal data that is necessary for the performance of a contract to which the data subject is a party, Art. 6 (1) (b) DSGVO serves as the legal basis. This also applies to processing operations that are necessary for the performance of pre-contractual measures.

Insofar as the processing of personal data is necessary for the fulfilment of a legal obligation to which our company is subject, Art. 6 (1) c DSGVO serves as the legal basis. In the event that vital interests of the data subject or another natural person make processing of personal data necessary, Art. 6 (1) (d) DSGVO serves as the legal basis.

Information and deletion

The personal data of the data subject will be deleted or blocked as soon as the purpose of storage ceases to apply. In addition, storage may take place if this has been provided for by the European or national legislator in Union regulations, laws or other provisions to which the person responsible is subject. Data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a necessity for the continued storage of the data for the conclusion or fulfilment of a contract.

If there are any changes to your personal data, we request that you inform us accordingly.

You have the right to revoke your consent to the use of your personal data at any time. Your request for information, deletion, correction, objection and/or data transfer in the latter case, provided that this does not involve disproportionate effort, can be directed to the address given in point XI.) of this declaration.

If you are of the opinion that the processing of your personal data by us violates the applicable data protection law or that your data protection rights have been violated in any other way, you have the possibility to complain to the competent supervisory authority. In Austria, the competent authority is the data protection authority.

Data security

Your personal data is protected by appropriate organisational and technical precautions. These precautions relate in particular to protection against unauthorised, illegal or even accidental access, processing, loss, use and manipulation. Notwithstanding our efforts to maintain an appropriately high standard of due diligence at all times, it cannot be ruled out that information you disclose to us via the Internet may be viewed and used by other persons.

Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorised access by third parties (e.g. hacker attack on e-mail account or telephone, interception of faxes).

Use of the data

We will not process the data provided to us for purposes other than the execution of the order. This does not include use for statistical purposes, provided that the data provided has been anonymised.

Disclosure of data breaches

We endeavour to ensure that data breaches are identified at an early stage and, if necessary, reported to you or the relevant supervisory authority without delay, including the respective categories of data affected.

Retention

We will not retain data for longer than is necessary to fulfil our contractual or legal obligations and to defend against any liability claims.

Cookies

This website uses “cookies” to make our services more user-friendly, effective and secure.

A “cookie” is a small text file that we transfer to the cookie file of the browser on the hard disk of your computer via our web server. This enables our website to recognise you as a user when a connection is established between our web server and your browser. Cookies help us to determine the frequency of use and the number of users of our web pages. The content of the cookies we use is limited to an identification number, which no longer allows any personal reference to the user. The main purpose is to recognise the visitor to the website.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or generally, as well as activate the automatic deletion of cookies when closing the browser. On this website, we use the Facebook Pixel from Facebook, a social media network of the company Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland. This can be used to improve Facebook ads. The data collected is not visible to us, but can only be used in the context of ad placements. Cookies are also set through the use of the Facebook pixel code.

We use the LinkedIn Insight Tag of the social media network LinkedIn, of the company LinkedIn Coporation, 2029 Stierlin Court, Mountain View, CA 94043, USA on this website. This can be used to improve LinkedIn advertisements. The collected data is not visible to us, but can only be used in the context of ad placements. Cookies are also set through the use of the LinkedIn Insight Tag.

Server log files

In order to optimise this website in terms of system performance, user-friendliness and the provision of useful information about our services, the website provider automatically collects and stores information in so-called server look files, which your browser automatically transmits to us. This includes your internet protocol address (VIP address), browser and language setting, operating system, referrer URL, your internet service provider and date/time. We do not combine this data with personal data sources. We reserve the right to check this data retrospectively if we become aware of specific indications of unlawful use.

Google Analytics

This website uses Google Analytics, an advertising analysis service provided by Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA, on the legal basis of overriding legitimate interest (analysis of website usage). We have concluded an order processing contract with Google for this purpose.

When our website is accessed, a connection to Google’s servers is established via software and data is transmitted to Google servers located in the USA. Google Analytics also uses cookies to store information about the website user and to analyse the use of the website.

This website uses the “IP anonymisation” function. This means that your IP address will be shortened beforehand by Google within member states of the European Union or other contracting states to the Agreement on the European Economic Area and thus anonymised. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.

According to Google, Google will use the data collected for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage.

Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf.

You can generally prevent the collection of your user data on our website by setting your web browser to “Do Not Track”. Our website takes into account the “Do Not Track” signal that the browser then sends to all websites.
